Terms and Conditions

These Terms and Conditions govern your access to and use of Folian, including the website at folian.app, the Folian desktop app, waitlist, downloads, purchases, help content, documentation and any related services that link to these terms.

In these Terms, "Folian", "we", "us" and "our" means ABL International. "You" means the person using Folian or visiting the website.

By accessing or using Folian, joining the waitlist, purchasing access, downloading the app or using the desktop app, you agree to these Terms.

If you do not agree, do not use Folian.

1. What Folian is

Folian is a desktop writing operating system for long-form fiction and related writing projects.

Folian may include features for:

  • Manuscript drafting.
  • Story bible management.
  • Canon and continuity.
  • Character records.
  • Location records.
  • Lore and worldbuilding.
  • Planning.
  • Style profiles.
  • Research.
  • Editing support.
  • AI provider settings.
  • Export.
  • Project organisation.

The Folian website is used to market, sell and support Folian for users globally.

Folian is designed to support writers. It does not guarantee that a book, manuscript, story, article or other creative work will be completed, published, accepted, sold or commercially successful.

2. Desktop-only product

Folian is currently a desktop-only application.

At this stage, Folian is not a cloud writing platform.

Documents and project content created in Folian are stored locally on the user's own machine.

You are responsible for protecting your device, backing up your files and maintaining access to your local project data.

3. Eligibility and user responsibility

Folian does not set a specific age restriction for use of the desktop app.

However, you are responsible for ensuring that your use of Folian is lawful in your location.

If you are not legally able to purchase software, enter contracts, use payment services or use third-party AI providers in your location, you should only use Folian with the involvement of a parent, guardian or other authorised person.

Any age restrictions, account restrictions or usage rules imposed by third-party AI providers, payment providers or app platforms are the responsibility of those providers and the user.

4. Purchases and payments

Folian may be sold through Lemon Squeezy.

Stripe or another payment provider may be used in the future.

By purchasing Folian, you agree to the price, product description, licence terms and checkout terms shown at the time of purchase.

Payment providers may have their own terms, refund rules, tax handling, privacy policies and fraud prevention processes.

You are responsible for providing accurate purchase and billing information.

5. No refunds

Folian purchases are non-refundable unless required by applicable law.

This is because users receive access to the app or download after purchase.

By purchasing Folian, you acknowledge that you are buying access to a downloadable desktop app and that no refund is offered once access or download has been provided.

If a payment provider, consumer law or platform rule requires a different refund process, that rule will apply only where legally required.

6. Downloads and access

After purchase, you may receive access to download Folian or instructions to access the app.

You are responsible for:

  • Downloading Folian from official sources.
  • Keeping your purchase email or licence information safe.
  • Installing Folian on a compatible device.
  • Maintaining your own device.
  • Keeping backups of your local files.

We may update download methods, licence systems or access processes over time.

7. Beta, early access and product changes

Folian may be offered as beta, early access, founder access or preview software.

Beta or early access software may be incomplete, unstable or subject to change.

You understand that Folian may include:

  • Bugs.
  • Missing features.
  • Changing workflows.
  • Incomplete documentation.
  • Interface changes.
  • Compatibility issues.
  • Feature changes.
  • Feature removals.
  • Export limitations.
  • AI provider setup requirements.

We may add, change, rename, limit, suspend or remove features as Folian develops.

8. Your content

You retain ownership of the content you create, import, write, store or export using Folian.

This may include:

  • Manuscripts.
  • Chapters.
  • Scenes.
  • Outlines.
  • Story bibles.
  • Canon records.
  • Character records.
  • Location records.
  • Lore and worldbuilding notes.
  • Style profiles.
  • Research notes.
  • Prompts.
  • AI outputs.
  • Exports.
  • Other creative materials.

ABL International does not claim ownership of your writing or creative work.

9. Local storage and backups

At this stage, documents and project content created in Folian are stored locally on your machine.

You are responsible for:

  • Backing up your writing projects.
  • Exporting important work.
  • Protecting your device.
  • Maintaining local storage.
  • Managing your own cloud backup if you use one.
  • Preventing accidental deletion.
  • Protecting access to your computer.

Folian should not be treated as the only copy of your work.

We are not responsible for loss of manuscripts, project files, writing data or creative work caused by device failure, user error, accidental deletion, lack of backups, local corruption, third-party services or events outside our reasonable control.

10. Responsibility for your content

You are responsible for your content.

You confirm that you have the rights needed to write, import, store, process, export and use your content in Folian.

You agree not to use Folian for content or activities that:

  • Break the law.
  • Infringe intellectual property rights.
  • Violate privacy or publicity rights.
  • Contain malware or harmful code.
  • Are used to harass, exploit, threaten or harm others.
  • Violate these Terms.

11. AI features are optional

Folian may include AI-assisted features.

AI use is optional.

You can use Folian as a writing OS without using AI features.

AI features may help with:

  • Brainstorming.
  • Drafting.
  • Summarising.
  • Editing.
  • Research.
  • Revision.
  • Continuity checks.
  • Style support.
  • Scene planning.
  • Project analysis.
  • Other writing-related tasks.

AI output may be inaccurate, incomplete, repetitive, biased, generic, unsuitable, offensive or inconsistent with your project.

You are responsible for reviewing and deciding whether to use any AI output.

Folian does not guarantee that AI output will be original, accurate, publishable, legally safe, commercially valuable or suitable for your intended use.

12. Bring your own AI keys

Folian uses a bring-your-own AI keys model where AI features are supported.

This means you may connect your own AI provider account or API key, such as OpenAI, Claude or another supported provider.

If you connect an AI provider:

  • You are responsible for your provider account.
  • You are responsible for your API keys.
  • You are responsible for usage charges from that provider.
  • You are responsible for reviewing that provider's terms and privacy policy.
  • You authorise Folian to use your key to send requests you initiate.
  • You understand that selected content may be sent to the provider to complete your request.

Folian is not responsible for charges, outages, errors, policy changes, model behaviour, data handling or service issues caused by third-party AI providers.

13. AI provider rules and age restrictions

Any age restrictions, usage restrictions, account rules, safety policies or billing requirements imposed by AI providers are between you and the AI provider.

Folian and ABL International are not responsible for whether a user is eligible to use a specific AI provider.

If you are not allowed to use a provider under that provider's terms, you should not connect that provider to Folian.

14. API key safety

You should treat API keys like passwords.

  • Do not share API keys publicly.
  • Do not include keys in screenshots.
  • Do not send keys through unsecured channels.
  • Do not paste keys into public documents or social media.
  • Revoke and replace keys if you believe they have been exposed.

You are responsible for securing your connected provider accounts.

15. AI output and intellectual property

Laws and platform rules around AI-generated content may vary by country, publisher, platform, marketplace and use case.

Folian does not provide legal advice about whether AI output is copyrightable, publishable, protectable or suitable for commercial use.

You are responsible for:

  • Reviewing AI output.
  • Editing and verifying content.
  • Ensuring your work does not infringe third-party rights.
  • Following publisher, platform or marketplace rules.
  • Making final creative and legal decisions about your work.

16. No professional advice

Folian may assist with writing, planning, research or editing, but it does not provide legal, financial, medical, tax, publishing, literary agent, editorial or professional advice.

Any information generated or provided through Folian should be independently reviewed before being relied on.

17. Research features

Folian may offer research or information-gathering features.

Research output may be incomplete, outdated, inaccurate or based on third-party sources.

You are responsible for verifying facts, citations, references and claims before using them in a manuscript, publication or commercial work.

18. Acceptable use

You agree not to use Folian to:

  • Break the law.
  • Infringe intellectual property rights.
  • Violate privacy rights.
  • Upload malware or harmful code.
  • Attempt to gain unauthorised access to Folian systems.
  • Reverse engineer, scrape or attack the website or product.
  • Interfere with product security.
  • Abuse, harass or harm others.
  • Generate or distribute unlawful content.
  • Misrepresent AI-generated content where disclosure is required.
  • Bypass payment requirements.
  • Resell Folian without permission.
  • Use Folian to build a competing product without permission.

We may suspend or terminate access for violations where applicable.

19. Feedback

If you join the waitlist, purchase Folian or use Folian, we may email you from time to time asking for feedback.

You are not required to respond.

If you provide feedback, suggestions, ideas, bug reports or feature requests, you give ABL International permission to use them to improve Folian without restriction or compensation.

You still own your own writing content.

20. Service changes

Folian may change over time.

We may add, change, rename, limit, suspend or remove features.

We may also update the website, pricing, product structure, AI integrations, supported providers, licences, download methods or documentation.

21. Availability

We aim to keep the Folian website and download access available, but we do not guarantee uninterrupted access.

The desktop app may depend on your device, operating system, local storage, third-party AI providers and other local or third-party conditions.

Folian may be unavailable or affected because of:

  • Maintenance.
  • Bugs.
  • Beta changes.
  • Server issues.
  • Third-party provider issues.
  • AI provider outages.
  • Payment provider issues.
  • Internet problems.
  • Security incidents.
  • Events outside our control.

22. Privacy

Our handling of personal information is explained in our Privacy Policy.

By using Folian, you also agree to the Privacy Policy.

23. Third-party services

Folian may connect to or rely on third-party services.

These may include:

  • Payment providers.
  • Download delivery providers.
  • Email providers.
  • Analytics tools.
  • AI providers.
  • Error monitoring tools.
  • Support tools.
  • Website hosting providers.

Third-party services may have their own terms, privacy policies and fees.

Folian is not responsible for third-party services that we do not control.

24. Intellectual property owned by Folian

Folian and its website, product design, software, interface, brand, logos, text, graphics, documentation, workflows and other materials are owned by ABL International or its licensors.

You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from Folian except as permitted by these Terms or applicable law.

25. Licence to use Folian

When you purchase or download Folian, you receive a limited, non-exclusive, non-transferable licence to install and use Folian according to these Terms and any purchase terms shown at checkout.

You do not receive ownership of the Folian software itself.

You may not resell, sublicense, distribute, copy or make Folian available to others unless we give written permission.

26. Publicity

We will not use your private manuscript content or private project content in marketing without your permission.

If you provide a testimonial, quote, public comment, review or case study permission, we may use it for marketing according to the permission you provide.

27. Termination

You may stop using Folian at any time.

We may suspend or terminate access to website services, downloads, updates or support if:

  • You violate these Terms.
  • You fail to pay fees.
  • You misuse the product.
  • You create legal or security risk.
  • You abuse support or other users.
  • We are required to do so by law.
  • We discontinue the product or service.

Termination does not remove your responsibility to comply with payment, intellectual property, acceptable use or liability provisions that survive termination.

28. Disclaimer of warranties

Folian is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy and reliability.

We do not guarantee that:

  • Folian will be uninterrupted.
  • Folian will be error-free.
  • All bugs will be fixed.
  • AI output will be accurate.
  • AI output will be original.
  • AI output will meet your expectations.
  • Your manuscript will be completed, published or successful.
  • Third-party providers will remain available.
  • Your local files will never be lost or corrupted.

29. Limitation of liability

To the maximum extent permitted by law, ABL International, Folian and their owners, directors, employees, contractors, affiliates and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption or loss of creative work.

To the maximum extent permitted by law, our total liability for any claim related to Folian will not exceed the amount you paid to Folian for the purchase giving rise to the claim, or USD 100 if you have not paid anything.

Some jurisdictions do not allow certain exclusions or limitations, so some of these limits may not apply to you.

30. Indemnity

You agree to indemnify and hold harmless ABL International, Folian and their owners, directors, employees, contractors, affiliates and service providers from claims, damages, liabilities, losses, costs and expenses arising from:

  • Your use of Folian.
  • Your content.
  • Your violation of these Terms.
  • Your violation of law.
  • Your infringement of third-party rights.
  • Your use of AI output.
  • Your use of third-party AI providers.
  • Your failure to maintain backups of your local files.

31. Governing law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.

32. Dispute resolution

Before bringing a formal claim, you agree to contact us first at:

We will try to resolve the dispute informally.

If a dispute cannot be resolved informally, it will be handled by the courts of the United Arab Emirates, unless applicable law requires otherwise.

33. Changes to these Terms

We may update these Terms from time to time.

If we make material changes, we will update the "Last updated" date and may notify users by email, website notice or product notice.

Your continued use of Folian after the updated Terms take effect means you accept the updated Terms.

34. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect.

35. Entire agreement

These Terms, together with the Privacy Policy, Cookie Policy and any additional terms shown at checkout or inside the product, form the entire agreement between you and Folian.
